Event Waiver, Release of Liability and Indemnity Agreement
I wish to participate in an event benefiting Crohn’s and Colitis Canada (the “Event”), including all pre- and post-event activities. I agree to abide by all Event rules, regulations, and instructions, as well as all applicable municipal, provincial, and federal laws and regulations.
I understand that participation in the Event and the use of services made available to participants involves inherent and potential risks, including but not limited to serious personal injury, illness, death, property damage or loss, and exposure to infectious diseases such as COVID-19. I am voluntarily assuming all such risks—known and unknown—that may result from my participation in the Event.
I warrant that I am in good physical health and possess sufficient fitness to safely participate in the Event and related activities. I further agree that if I observe any unsafe conditions or feel unfit or unable to continue for any reason, I will immediately discontinue participation and notify a representative of Crohn’s and Colitis Canada or medical personnel as appropriate.
In consideration for being permitted to participate in the Event, I, on behalf of myself and my heirs, executors, administrators, assigns, and personal representatives, hereby release, waive, and forever discharge Crohn’s and Colitis Canada, its officers, directors, employees, volunteers, sponsors, affiliates, successors, agents, and representatives (collectively, the “Releasees”) from any and all claims, demands, causes of action, damages, losses, or liabilities (whether known or unknown, in law or in equity) that may arise out of or relate in any way to my participation in the Event—whether as a participant, volunteer, spectator, or otherwise—and regardless of whether such loss, injury, illness, or damage was caused in whole or in part by the negligence of any of the Releasees.
I further agree to indemnify and hold harmless the Releasees from and against any and all liabilities, claims, costs, damages, and expenses (including legal fees) arising from or related to my participation in the Event, including but not limited to any injury, illness, property damage, or third-party claims.
I acknowledge and agree that Crohn’s and Colitis Canada does not provide any insurance coverage for participants in the Event, including life, medical, or liability insurance. I understand it is my responsibility to obtain such insurance if I desire coverage. I agree to be solely responsible for any medical expenses incurred in connection with any illness, accident, or injury I may suffer in relation to the Event.
I waive any right of recovery against the Releasees for losses covered by any insurance policy under which I am insured and agree to notify my insurer of this waiver of subrogation if applicable.
I understand that my participation in the Event is subject to the discretion of Crohn’s and Colitis Canada and may be limited, revoked, or terminated at any time, with or without cause.
I give Crohn’s and Colitis Canada and its affiliates, agents, and representatives permission to use my name, voice, image, video, photograph, and statements in any and all forms of media or promotional materials, including online platforms and social media, in connection with the Event or future events. I acknowledge that once published online, such materials may be copied or shared by third parties, and I release Crohn’s and Colitis Canada from liability related to such use.
This Waiver, Release, and Indemnity Agreement shall be governed by and interpreted in accordance with the laws of Canada. Any dispute arising from this agreement or participation in the Event shall be subject to the exclusive jurisdiction of the courts of Canada.
I certify that I have read this Waiver, Release, and Indemnity Agreement in its entirety, that I fully understand its contents, and that I am voluntarily signing it. I acknowledge that by doing so, I am waiving substantial legal rights.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
